The bench comprising Justice Nitin Jamdar and Justice Surendra Tavade on hearing a petition filed by the mother of 12 year old rape survivor seeking medical termination of pregnancy of her 23 week old pregnancy have allowed for the termination of pregnancy based on the report submitted by the Government Medical College at Miraj which stated that it will affect general and mental health of the survivor if the pregnancy was allowed to progress. ( As MTP Act, 1971 allows for termination of pregnancy up to 20 weeks only).
