Allahabad HC: Less Than 5 Persons Can’t Be Convicted For Dacoity

The Allahabad HC While delivering a judgment in an appeal filed by Balbir and others against the judgment passed by trial court of Kanpur in the case of State v. Balbir and others held that in the absence of five or more persons no conviction could be made out under Sections 395 (Punishment for dacoity) and 397 (Robbery, or dacoity, with attempt to cause death or grievous hurt) as it is against he essential ingredients of Section 391 of IPC.
