‘Sakha and Sandoor’- The legal significance of marriage

The Hon’ble HC of Gauhati held in one of its judgements that “refusal to wear Sakha and Sandoor signify a woman’s refusal of marriage”. The judges opined that the wife in cross-examination confirmed that she don’t wear Sakha and Sindoor because she do not consider his life partner to be her husband and under customs of Hindu Marriage, a women who does not wear ‘sakha and sandoor’, and the same is affirmed by her will tend towards refusal from acceptance of marriage.
The court reattired that wife’s will for separating parents from son amounts to cruelty as parents have right to be maintained under “maintenance and welfare of parents and senior citizen act, 2007”.
